Terms and Conditions - General Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) govern the relationship between RosenBouquet.ch / ICT & Professionals Switzerland AG (hereinafter referred RosenBouquet.ch) as operator of the website and its customers. Deviating agreements must be made in writing to be valid. For customer orders in the online shop, these general terms and conditions apply exclusively.
2. Shipping and delivery costs
The articles are sent to Switzerland and Liechtenstein.
Orders with a delivery address in Switzerland and Liechtenstein are shipped free of charge for orders of CHF 100 or more. For orders under CHF 100, shipping costs of CHF 12 including VAT will be charged.
In the event of delivery bottlenecks, RosenBouquet.ch reserves the right to make partial deliveries. The resulting additional shipping costs are borne by RosenBouquet.ch.
Shipping is at the customer's risk and the customer must check the delivery received in the presence of the courier and have any damage acknowledged by the courier (we only send with proof of delivery).

3. Availability
As a rule, orders from Monday to Saturday mornings by 12 noon are dispatched on the same day. The products are put together individually for customers and therefore the delivery time can vary from 1-7 working days. Delays in delivery do not justify claims for damages of any kind.
If, in exceptional cases, a product cannot be delivered within 7 working days, customers will be informed as soon as possible. If desired, this article can then be replaced by an equivalent one. If the customer rejects a delay and an equivalent item, the customer can cancel the order in writing at RosenBouquet.ch at no cost and the customer will be reimbursed the purchase price paid in full.
All orders only become binding for RosenBouquet.ch once the goods have been delivered.
4. Prices and terms of payment
All prices are in Swiss francs including statutory value added tax (VAT). The purchase prices are to be paid in advance. You can choose from the following payment options:
4.1 Prepayment
You will automatically receive our account details for your prepayment after completing the order.
4.2 Payment by debit and credit cards
Your secure credit and debit card payments are made possible by renowned external online payment services. These companies meet all common security standards.
4.3 Payment with PayPal
You can pay the invoice amount for your order directly with your PayPal account.
5. Right to exchange or return
Since each article is individually made for the customer, a right of return for purchases made through RosenBouquet.ch is fundamentally excluded. In the event of any returns (as a gesture of goodwill) the delivery costs are always borne by the buyer. Returns must in any case be returned in an undamaged condition and in the safe shipping packaging specially made for the item.
6. Notice of defects
Complaints must be made in writing within 7 days of the delivery date.
7. Retention of Title
All delivered items remain the property of RosenBouquet.ch until the purchase price has been paid in full (including all surcharges). Pledging, assignment by way of security, processing or redesign is not permitted without the express consent of RosenBouquet.ch. RosenBouquet.ch is entitled to have the delivered goods entered in the retention of title register in accordance with Art. 715 ZGB. If the customer is in arrears with any payment obligations towards RosenBouquet.ch, all existing claims are due immediately.
8. Data protection
RosenBouquet.ch undertakes to process customer data carefully and to comply with the provisions of Swiss data protection. RosenBouquet.ch uses personal data for the contractually and legally compliant processing and fulfillment of the services offered, for maintaining customer relationships and for developing, designing and submitting offers and articles as required. The customer can prohibit the processing of his data for marketing purposes at any time. A corresponding notification can be sent in writing to the following address, stating the customer number: RosenBouquet.ch / ICT & Professionals Schweiz AG, Feldhof 9, 6300 Zug.
As part of the processing of personal data that is necessary for the conclusion or processing of a contract, RosenBouquet.ch can exchange data with authorities as well as with companies entrusted with the collection of debts or the credit report or transfer data to them if the exchange or the handover takes place to check the creditworthiness or to assert claims.
RosenBouquet.ch cannot guarantee the security of data transmission on the Internet. When transmitting data by email, there is a particular risk of access by third parties.
8.1 Google
This website uses retargeting technology from Google Inc. (“Google”). This makes it possible to target visitors to our website with personalized, interest-based advertising who have already shown an interest in our shop and our products. The advertising material is displayed on the basis of a cookie-based analysis of previous usage behavior, but no personal data is stored. In the case of retargeting technology, a cookie is stored on your computer or mobile device in order to collect anonymized data about your interests and thus adapt the advertising individually to the stored information. These cookies are small text files that are stored on your computer or mobile device. As a result, you will receive advertising that is very likely to correspond to your product and information interests. 9. Changes and various provisions
RosenBouquet.ch reserves the right to change the terms and conditions at any time and without notice. The current version of the GTC published at www.RosenBouquet.ch applies.
10. Place of jurisdiction
Swiss law applies. The place of jurisdiction is Zug. Mandatory statutory provisions remain reserved.
11. Further provisions
The ineffectiveness of individual provisions of these terms and conditions does not affect the effectiveness of the remaining provisions.
